Bigdomainhost respects intellectual property rights and expects its customers to do the same. As an intermediary under section 79 of the Information Technology Act, 2000, we act on valid notices under the Copyright Act, 1957, the Copyright Rules, 2013, the Digital Millennium Copyright Act (for US rightsholders) and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
1. Sending a takedown notice
Email support@bigdomainhost.com with the subject line “DMCA / COPYRIGHT NOTICE”. A valid notice must contain:
- Your physical or electronic signature, as the owner or an authorised agent of the owner of the right claimed to be infringed.
- Identification of the copyrighted work claimed to be infringed — the registration number, the original URL, or a copy of the work.
- The exact URL of the allegedly infringing material on our network. A domain name alone is not enough.
- Your name, postal address, telephone number and email address.
- A statement that you believe in good faith that the use is not authorised by the owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on the owner's behalf.
- Details of the location where the material is to be blocked, and the period for which it is to be blocked, where you rely on the Copyright Rules, 2013.
Incomplete notices cannot be acted upon; we will write back and say what is missing.
2. What we do next
- Acknowledge your notice within 24 hours.
- Forward it to the customer and ask them to remove the material, usually within 24–48 hours.
- Disable access to the material ourselves if the customer does not act, or immediately where the infringement is obvious.
- Record the action. Under Rule 75 of the Copyright Rules, 2013, material disabled on a private notice is restored after 21 days unless you produce an order from a competent court within that period.
- Terminate repeat infringers, per clause 4.
3. Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, send a counter-notice to support@bigdomainhost.com containing:
- your signature, name, postal address, phone number and email;
- identification of the material removed and the location it appeared at before removal;
- a statement under penalty of perjury that you believe in good faith the material was removed as a result of mistake or misidentification;
- your consent to the jurisdiction of the courts at Agra, Uttar Pradesh, India.
We forward valid counter-notices to the complainant. Absent a court order, access may be restored in 10 to 14 business days.
4. Repeat infringers
We keep a record of notices per account. An account that receives three validated notices in a rolling 12-month period is terminated without refund, in line with our Terms of Service.
5. Misuse of this process
Knowingly filing a false notice is itself actionable. We reserve the right to recover costs, and to decline further notices from a sender who has repeatedly filed bad-faith claims.
6. Other abuse
Spam, phishing, malware, network attacks and other misuse are handled under the Acceptable Use Policy. Send those reports to support@bigdomainhost.com with the subject “ABUSE REPORT”, or call +91 75994 50220 if it is urgent.
7. Law enforcement requests
Requests from Indian law-enforcement agencies and courts should be sent on official letterhead to support@bigdomainhost.com and to the postal address below. We respond to valid legal process and preserve data on written request pending an order.
